Acceptance
These Terms of Use ("Terms") are a binding agreement between you and History Drive-By ("we", "us") governing your use of the History Drive-By mobile application and related services (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
The service
History Drive-By is a road-trip companion that generates a driving route and streams narrated historical points of interest along the way. The App is provided for personal, non-commercial use. You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use it.
Your account
- You are responsible for keeping your login credentials secure and for all activity under your account.
- You agree to provide accurate information and not to impersonate others or share your account.
- You may delete your account at any time from within the App (Settings → Manage Account → Delete Account) or by request at our account-deletion page. Deletion permanently removes your account and associated data.
Premium purchase and billing
History Drive-By is free to download. A free account includes one generated route per calendar month. Premium is a one-time purchase — not a subscription, and nothing auto-renews. Purchasing Premium grants lifetime access for the purchasing account, including if future pricing moves to a subscription model.
- Billing is handled by the app stores. The one-time purchase is made through your Apple App Store or Google Play account, subject to their terms. We do not receive or store your payment details.
- Lifetime access. A completed purchase grants permanent Premium access tied to your account. Founder buyers keep Premium access regardless of any future pricing changes.
- Fair use. Premium route generation is capped at 250 routes per calendar month to prevent abuse. The free tier includes 1 route per calendar month.
- Refunds. Refunds are handled by Apple or Google under their respective store policies. We do not process payments and generally cannot issue refunds directly.
Complimentary access
We may grant complimentary Premium access to certain users at our discretion. Complimentary access confers no payment obligation, can be modified or revoked at any time, and is not a purchased subscription.
Acceptable use
You agree not to:
- Use the App while driving in a manner that distracts you from operating your vehicle safely, or in violation of any traffic or distracted-driving law. You are solely responsible for safe and lawful operation of your vehicle.
- Reverse-engineer, scrape, overload, or interfere with the App or its backend, or attempt to access it other than through the provided interface.
- Resell, redistribute, or use the App or its content for commercial purposes without our written permission.
Content and accuracy
Narrated points of interest are generated from public data sources and automated systems. While we work to ground content in real sources, it is provided for informational and entertainment purposes only and may contain inaccuracies, omissions, or outdated information. Do not rely on it for navigation, safety, legal, or other consequential decisions. Routes and drive-time estimates are approximate.
Intellectual property
The App, its design, and its original content are owned by us and protected by applicable law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal use under these Terms. Underlying facts and third-party source material remain the property of their respective owners.
Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that content will be accurate or complete.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the App, including any reliance on its content or any incident occurring while driving. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the twelve months before the claim.
Termination
We may suspend or terminate your access if you violate these Terms or misuse the App. You may stop using the App and delete your account at any time. Sections that by their nature should survive termination (including content/accuracy disclaimers, intellectual property, disclaimers, and limitation of liability) will survive.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above and, where appropriate, by notice in the App. Continued use after changes take effect constitutes acceptance.
